EHS observed the facility not having the CFSM posted for public viewing.
CA-PIC needs to make sure that the facility obtain atleast one CFSM and have it posted inside of the facility.
511-6-1.03(3)(a) - Food Safety Manager Certification (Pf) Food service establishments shall have in its employ a Certified Food Safety Manager (CFSM) as specified in paragraph (b) of this subsection to ensure food safety is being managed within the food service establishment during all hours of operation as specified within paragraph (d) of this subsection. 511-6-1.03(4)(a)(b)(c)(e)(f) - Responsibility of permit holder, PIC, and Conditional employees (P), (Pf) (a) Requirement to Report Symptoms, Diagnosis and History of Exposure. The permit holder shall require food employees and conditional employees to report to the CFSM and person in charge, information about their health and activities as they relate to diseases that are transmissible through food. A food employee or conditional employee shall report the information in a manner that allows the CFSM and person in charge to reduce the risk of foodborne disease transmission, including providing necessary additional information, such as the date of onset of symptoms and an illness, or of a diagnosis without symptoms, if the food employee or conditional employee:
- Has any of the following symptoms:
(i) Vomiting, P
(ii) Diarrhea, P
(iii) Jaundice, P
(iv) Sore throat with fever, P or
(v) A lesion containing pus such as a boil or infected wound that is open or draining and is:
(I) On the hands or wrists, unless an impermeable cover such as a finger cot or stall protects the lesion and a single-use glove is worn over the impermeable cover as specified under subsection(5)(g) of this Rule, P
(II) On exposed portions of the arms, unless the lesion is protected by an impermeable cover, P or
(III) On other parts of the body, unless the lesion is covered by a dry, durable, tight-fitting bandage; P
- Has an illness diagnosed by a health practitioner due to:
(i) Norovirus, P
(ii) Hepatitis A virus, P
(iii) Shigella spp., P
(iv) Shiga toxin-producing Escherichia coli, P
(v) Salmonella Typhi; P or
(vi) nontyphoidal Salmonella; P

Had a previous illness, diagnosed by a health practitioner, within the past three months due to Salmonella Typhi, without having received antibiotic therapy, as determined by a health practitioner; P
-
Had been exposed to, or is the suspected source of, a confirmed disease outbreak, because the food employee or conditional employee consumed or prepared food implicated in the outbreak, or consumed food at an event prepared by a person who is infected or ill with:
(i) Norovirus within the past 48 hours of the last exposure, P
(ii) Shiga toxin-producing Escherichia coli, or Shigella spp. within the past three days of the last exposure, P
(iii) Salmonella Typhi within the past 14 days of the last exposure, P or
(iv) Hepatitis A virus within the past 30 days of the last exposure; P or
- Has been exposed by attending or working in a setting where there is a confirmed disease outbreak, or living in the same household as, and has knowledge about, an individual who works or attends a setting where there is a confirmed disease outbreak, or living in the same household as, and has knowledge about, an individual diagnosed with an illness caused by:
(i) Norovirus within the past 48 hours of the last exposure, P
(ii) Shiga toxin–producing Escherichia coli, or Shigella spp. within the past three days of the last exposure, P
(iii) Salmonella Typhi within the past 14 days of the last exposure, P or
(iv) Hepatitis A virus within the past 30 days of the last exposure. P
(b) Responsibility of Person in Charge to Notify the Health Authority. The CFSM or person in charge shall notify the Health Authority when a food employee is:

Diagnosed with an illness due to Norovirus, Hepatitis A virus, Shigella spp., Shiga toxin-producing Escherichia coli, or Salmonella Typhi. P
(c) Person in Charge’s Responsibility to Prohibit a Symptomatic Conditional Employee. The person in charge shall ensure that a conditional employee:

Who exhibits or reports a symptom, or who reports a diagnosed illness as specified under subsection (4)(a)1 - 3 of this Rule, is prohibited from becoming a food employee until the conditional employee meets the criteria for the specific symptoms or diagnosed illness as specified under subsection (4)(h) of this Rule; P and

Who will work as a food employee in a food service establishment that serves as a highly susceptible population and reports a history of exposure as specified under subsections (4)(a)4 and 5 of this Rule, is prohibited from becoming a food employee until the conditional employee meets the criteria as specified under subsection (4)(h)10 of this Rule. 2-2E - response procedures for vomiting & diarrheal events

EHS requested for bodily fluid kit.
CA-PIC stated that he did not know where it was or what the kit look like. 511-6-1.03(6) - Clean-up of Vomiting and Diarrheal Events(Pf) (6) Responding To Contamination Events. A food establishment shall have written procedures for employees to follow and an EPA registered disinfectant effective against Norovirus available on-site at the food service establishment when responding to vomiting or diarrheal events that involve the discharge of vomitus or fecal matter onto surfaces in the food service establishment. The procedures shall address the specific actions employees must take to minimize the spread of contamination and the exposure of employees, consumers, food, and surfaces to vomitus or fecal matter.Pf

EHS observed a bucket of sugar in the back near the walk in cooler. The container was sitting on the table with no lid or covering.
CA-EHS informed PIC that the item must be covered if not in use.

EHS observed the PIC putting toppings on the pizza with his bare hands. PIC was reaching in each container to place the toppings on the pizza.
CA-PIC informed PIC that he needs to either wear gloves or have a scoop (make sure the handles are not touching the product). This is to reduce any possible contamination.

12A - contamination prevented during food preparation, storage, display

EHS observed a hot holding display table. A employee was lacing hot pizza on the unit. The display did not have any covering to protect the pizza from contamination.
CA-EHS informed Owner that he will need to install a safe guard in front of the pizza and have something on top to cover the top of the pizza.

Protective devices for counters, serving lines, salad bars and other similar food displays in food service establishments shall be designed and constructed so as to intercept contaminants which may be expelled from the customer's mouth or nose.

All food, whether on display, being prepared for service or placed for consumer self-service must be protected from contamination from consumers standing or sitting within eight feet of the food, except that table side finishing as approved by the Health Authority and hibachi grills will be allowed when food preparation is for immediate service.
12B - personal cleanliness

EHS observed the PIC handling food without any hair restraint. EHS requested if the facility has any hair restraints and he stated he had no knowledge of where it is. CA- Any employee that is handling food must have on a hair restraint.

Employees preparing or handling food shall use effective and clean, disposable or easily cleanable nets or other hair restraints approved by the Health Authority, worn properly to restrain loose hair including beards and mustaches longer than one half inch.

This does not apply to employees such as counter staff who only serve beverages and wrapped or packaged foods, hostesses, and wait staff if they present a minimal risk of contaminating exposed food, clean utensils and linens and unwrapped single-service and single-use articles.
13A - posted: permit/inspection/choking poster/handwashing

EHS observed the food permit not posted for public viewing.
CA-PIC needs to obtain the food permit that was issued to the facility from the health department and have it posted for public viewing.

15C - nonfood-contact surfaces clean
Regulation: 511-6-1.05(7)(a)2,3 - equipment, food/nonfood-contact surfaces, and utensils, food-contact surfaces of cooking equipment & nonfood-contact surfaces free of accumulations (c)
EHS observed every reach in cooler in the facility was in need of cleaning. The prep top cooler where the pizza toppings are held had food debris in the corners of the unit.
CA-PIC contacted the owner and EHS talked to the owner about what I observed. EHS informed the owner about the units that needed to be cleaned. He stated that he was going to get rid of the two reach in coolers by the drive thru. Then he stated that he would clean the reach cooler by the prep top and also clean the prep top cooler. The PIC needs to make sure that the units are being cleaned routinely to reduce food build up in the units.
511-6-1.05(7)(a)2,3 - Equipment, Food/Nonfood-Contact Surfaces, and Utensils, food-contact surfaces of cooking equipment & nonfood-contact surfaces free of accumulations (C) 2. The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and other soil accumulations.
- Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
