Regulation: 511-6-1.06(2)(o) - using a handwashing sink- operation & maintenance (pf)
Hand wash sink was full of dishes and utensils at the start of the inspection. CA: 1.A handwashing sink shall be maintained so that it is accessible at all times for employee 2.A handwashing facility may not be used for purposes other than handwashing. 3.An automatic handwashing facility shall be used in accordance with manufacturer's instructions. COS: Dishes were removed from the sink and hands were rewashed.
5-2 - consumer advisory provided for raw and undercooked foods
Regulation: 511-6-1-.04(7)(e) - consumer advisory provided for raw/undercooked
Restaurant is now advertising 12oz Ribeye Steaks that are cooked to order. Each table has a "doneness scale" on them but no consumer advisory on the menu nor the scale at each table advising or the risk of eating raw or undercooked food.
CA: 1.Except as specified in subsections (5)(a)3., and (5)(a)4(iv)., and (9)(a)3. of this Rule, if an animal food such as beef, eggs, fish, lamb, pork, poultry, or shellfish is served or sold raw, undercooked, or without otherwise being processed to eliminate pathogens, either in ready-to-eat form or as an ingredient in another ready-to-eat food, the permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder, as specified in paragraphs 2. and 3. of this subsection using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. The disclosure and reminder statements shall be worded in legible type in all capital letters and no smaller than font size #8, or if displayed on a menu board shall be printed no smaller than the smallest lettering used for a menu item. 2.Disclosure shall include: (i)A description of the animal-derived foods, such as “oysters on the half shell (raw oysters),” “raw-egg Caesar salad,” and “hamburgers (can be cooked to order);” or (ii) Identification of the animal-derived foods by asterisking them to a footnote that states that the items are served raw or undercooked, or contain (or may contain) raw or undercooked ingredients. 3.The reminder shall include asterisking the animal-derived foods requiring disclosure to a footnote that states: (i) Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness; or (ii) Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.
Steaks shall not be offered for service again until an advisory statement has been placed in effective written means to advise the public of the risks of consuming undercooked food. This shall be verified by Health Department prior to further sale of steaks. Correct within 72 Hours.
12B - personal cleanliness
Regulation: 511-6-1.03(5)(j) - hair restraints (c)
Observed employees with longer facial hair but no bearbuard or beard restraint on. CA:Employees preparing or handling food shall use effective and clean, disposable or easily cleanable nets or other hair restraints approved by the Health Authority, worn properly to restrain loose hair including beards and mustaches longer than one half inch. Correct within 72 hours.
18 - insects, rodents, and animals not present
Regulation: 511-6-1.07(5)(k) - controlling pests (pf, c)
Observed rat dropping in the back storage closet again. Less than last time but the presence is still enough that leavings are noticeable. CA:The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by:
1.Routinely inspecting incoming shipments of food and supplies;
2.Routinely inspecting the premises for evidence of pests;
3.Using methods, if pests are found, such as trapping devices or other means of pest control as specified under subsections (6)(e), (6)(m), and (6)(n) of this Rule;Pf and
4. Eliminating harborage conditions.
No professional pest company is being used and there is no consistent evidence of application or trap rotation. Recommend keeping a log or journal of date and actions taken on those days at the very minimum if pest control is still wanting to be done by owner.
16B - plumbing installed; proper backflow devices
Regulation: 511-6-1.06(2)(r) - system maintained in good repair (p, c)
3 compartment sink has a leak on 2 of its faucets (wash and rinse). One is steady and the other is a slow drip. CA: Plumbing shall be maintained in good repair against leaks. Correct within 1 week.
16C - sewage and waste water properly disposed
Regulation: 511-6-1.06(4)(d),(e) - grease trap; conveying sewage (c, p)
Mop water being dumped into the drainage ditch next to the facility instead of the mop sink. CA:Sewage shall be conveyed to the point of disposal through an approved sanitary sewage system or other system, including use of sewage transport vehicles, waste retention tanks, pumps, pipes, hoses, and connections that are constructed, maintained, and operated according to law. Mops shall be disposed of into the proper mop sink.
