Observed the location does not have an employee health policy that is provided, reviewed, and signed by employees. PIC will issue and obtain a signed copy of the employee health policy for each employee by 1/15/26.
511-6-1.03(4)(a)(b)(c)(e)(f) - Responsibility of permit holder, PIC, and Conditional employees (P), (Pf) (a) Requirement to Report Symptoms, Diagnosis and History of Exposure. The permit holder shall require food employees and conditional employees to report to the CFSM and person in charge, information about their health and activities as they relate to diseases that are transmissible through food. A food employee or conditional employee shall report the information in a manner that allows the CFSM and person in charge to reduce the risk of foodborne disease transmission, including providing necessary additional information, such as the date of onset of symptoms and an illness, or of a diagnosis without symptoms, if the food employee or conditional employee:
- Has any of the following symptoms:
(i) Vomiting, P
(ii) Diarrhea, P
(iii) Jaundice, P
(iv) Sore throat with fever, P or
(v) A lesion containing pus such as a boil or infected wound that is open or draining and is:
(I) On the hands or wrists, unless an impermeable cover such as a finger cot or stall protects the lesion and a single-use glove is worn over the impermeable cover as specified under subsection(5)(g) of this Rule, P
(II) On exposed portions of the arms, unless the lesion is protected by an impermeable cover, P or
(III) On other parts of the body, unless the lesion is covered by a dry, durable, tight-fitting bandage; P
- Has an illness diagnosed by a health practitioner due to:
(i) Norovirus, P
(ii) Hepatitis A virus, P
(iii) Shigella spp., P
(iv) Shiga toxin-producing Escherichia coli, P
(v) Salmonella Typhi; P or
(vi) nontyphoidal Salmonella; P

Had a previous illness, diagnosed by a health practitioner, within the past three months due to Salmonella Typhi, without having received antibiotic therapy, as determined by a health practitioner; P
-
Had been exposed to, or is the suspected source of, a confirmed disease outbreak, because the food employee or conditional employee consumed or prepared food implicated in the outbreak, or consumed food at an event prepared by a person who is infected or ill with:
(i) Norovirus within the past 48 hours of the last exposure, P
(ii) Shiga toxin-producing Escherichia coli, or Shigella spp. within the past three days of the last exposure, P
(iii) Salmonella Typhi within the past 14 days of the last exposure, P or
(iv) Hepatitis A virus within the past 30 days of the last exposure; P or
- Has been exposed by attending or working in a setting where there is a confirmed disease outbreak, or living in the same household as, and has knowledge about, an individual who works or attends a setting where there is a confirmed disease outbreak, or living in the same household as, and has knowledge about, an individual diagnosed with an illness caused by:
(i) Norovirus within the past 48 hours of the last exposure, P
(ii) Shiga toxin–producing Escherichia coli, or Shigella spp. within the past three days of the last exposure, P
(iii) Salmonella Typhi within the past 14 days of the last exposure, P or
(iv) Hepatitis A virus within the past 30 days of the last exposure. P
(b) Responsibility of Person in Charge to Notify the Health Authority. The CFSM or person in charge shall notify the Health Authority when a food employee is:

Jaundiced, Pf or
-
Diagnosed with an illness due to Norovirus, Hepatitis A virus, Shigella spp., Shiga toxin-producing Escherichia coli, or Salmonella Typhi. P
(c) Person in Charge’s Responsibility to Prohibit a Symptomatic Conditional Employee. The person in charge shall ensure that a conditional employee:

Who exhibits or reports a symptom, or who reports a diagnosed illness as specified under subsection (4)(a)1 - 3 of this Rule, is prohibited from becoming a food employee until the conditional employee meets the criteria for the specific symptoms or diagnosed illness as specified under subsection (4)(h) of this Rule; P and

Who will work as a food employee in a food service establishment that serves as a highly susceptible population and reports a history of exposure as specified under subsections (4)(a)4 and 5 of this Rule, is prohibited from becoming a food employee until the conditional employee meets the criteria as specified under subsection (4)(h)10 of this Rule. P (e) Responsibility of Food Employee and Conditional Employee to Report. A food employee or conditional employee shall report to the person in charge the information as specified under subsection (4)(a) of this Rule. Pf
(f) Responsibility of Food Employee to Comply. A food employee shall comply with an exclusion or restriction and with a removal, adjustment or retention of an exclusion or restriction. P
2-2B - proper eating, tasting, drinking, or tobacco use

Observed an open employee drink bottle containing a red liquid stored with food in the reach in preparation cooler. PIC advised that it was left by an employee on a prior shift. PIC corrected on site by discarding the drink bottle.
2-2D - adequate handwashing facilities supplied & accessible
Regulation: 511-6-1.07(3)(a) - handwashing cleanser, availability (pf)
Observed hand washing soap was not provided in the establishment. PIC advised that he was getting a delivery on 1/22/26. PIC was advised to immediately go to the store and obtain hand soap to prevent closure of the establishment due to employees not having the ability to properly wash their hands. PIC corrected on site by going to Publix to purchase handsoap.
511-6-1.07(3)(a) - Handwashing Cleanser, Availability (Pf) (3) Numbers and Capacities.

4-2B - food-contact surfaces: cleaned & sanitized

Observed the chlorine sanitizer in the three compartment sink at the bar did not contain the minimum required strength concentration. The chlorine sanitizer was observed at 0 ppm. PIC corrected on site. Once corrected, the sanitizer was observed at 50 ppm.
511-6-1.05(6)(n) - Manual and Mechanical Warewashing Equipment, Chemical Sanitization-Temperature, pH, Concentration, Hardness (P,Pf) (n) Manual and Mechanical Warewashing Equipment, Chemical Sanitization - Temperature, pH, Concentration, and Hardness. A chemical sanitizer used in a sanitizing solution for a manual or mechanical operation at contact times specified under subsection (8)(b)3 of this Rule shall meet the requirements specified in DPH Rule 511-6-1-.07(6)(g), shall be used in accordance with the Environmental Protection Agency (EPA)-registered label use instructions P, and shall be used as follows:

Observed chemical bottles actively being used did not contain a label with the common name of the blue liquid that was observed in the bottle. PIC advised that the bottle contained fabulosa. PIC advised to use an approved sanitizer to disinfect tables in between customers.

Observed the waste waste pipe leaking beneath the vegetable sink. PIC advised the leak was caused by a staff member that damaged the pipe during cleaning. Observed the current inspection report was not posted in public view. PIC will post the new inspection report by 1/21/26.

The most current inspection report shall be prominently displayed in public view at all times, within fifteen feet of the front or primary public door and between five feet and seven feet from the floor and in an area where it can be read at a distance of one foot away.

Food service establishments with drive-thru windows will post the current inspection report, and also have the inspection report posted so that a minimum of the top one-third of a copy of the current inspection report is visible through each window allowing customers to easily read the score, date of inspection and establishment information.

At food service establishments with no primary or public door, the current inspection report shall be prominently displayed at all times where the documents can be read by the public from a distance of one foot away. If requirements of this paragraph are not possible because of physical restrictions, a location will be determined as approved by the Health Authority.

The most current inspection report for mobile food service units and extended food service units issued by the local Health Authority having jurisdiction for its inspections shall be prominently displayed in public view during all hours of operation. Such inspection reports shall be prominently displayed at the point of service where the documents can be read by the public from a distance of one foot away.

A food service establishment inspection report addendum need not be displayed, but shall be made available by the food service establishment to the public upon request.

Observed employee belongings (Caramax lip treatment) stored in an area above the dish storage area on the preparation line. PIC advised to relocate personal items to a designated area.
