6-1A - proper cold holding temperatures
Regulation: 511-6-1.04(6)(f) - time/temperature control for safety; cold holding (p)
Base Violation: Observed TCS foods above 41F in residential refrigerator. CA: Discard TCS food inside the white residential unit and do not use this out of temp residential unit to hold TCS foods. COS: Temperature setting adjusted. Must monitor with a calibrated thermometer to ensure change will keep food at or below 41F.
4-2B - food-contact surfaces: cleaned & sanitized
Regulation: 511-6-1.05(7)(a)1 - equipment, food-contact surfaces,& utensils (pf)
Base Violation: Rodent droppings were observed on prep table surface and slicer. CA: Clean and sanitize all exposed food contact surfaces.
6-2 - proper date marking and disposition
Regulation: 511-6-1.04(6)(g) - ready-to-eat time/temperature control for safety food, date marking (pf)
Base Violation: Observed numerous containers of food in refrigerators missing date marking. CA: Discard of undated TCS foods and devise a datemarking procedure for cold held TCS foods. Unlabeled foods cannot be used for the business.
18 - insects, rodents, and animals not present
Regulation: 511-6-1.07(5)(k) - controlling pests (pf, c)
Violation of Code: [511-6-1.07(5)(k)] Rodent droppings observed. CA: Have certified pest control operator treat for rodents. Provide proof of service. New Violation.
10D - food properly labeled; original container
Regulation: 511-6-1.04(4)(d) - food storage containers identified with common name of food (c)
Base Violation: Observed house made vacuum sealed cooked meats in freezer. Facility is missing proof of variance to rule .04(6)(l) and no approved HACCP plan exists. CA: Discard house vacuum sealed meats in freezer. Discontinue freezing food in bags and only hold food in bags for less than 48 hours. You may apply for a variance with the state office or apply for approval of a HACCP plan that follows section (k) of this Rule. Contact health department for details.
11A - proper cooling methods used: adequate equipment for temperature control
Regulation: 511-6-1.05(3)(a) - cooling, heating, and holding capacities (pf)
Missing working refrigeration on unit. Observed empty cooler not running. Observed 76F ambient air. CA: Temporary alternative means of holding food in temperature may be approved upon request. Provide proof of ANSI / NSF of replacement cold holding equipment that will hold at 41F or below.
16A - hot and cold water available; adequate pressure
Regulation: 511-6-1.06(1)(g),(h) - water supply, capacity; pressure (pf)
Base Violation: Observed water turned off due to leak. CA: repair. Cos: Part added to exterior faucet to repair leak. Water turned back on.
16C - sewage and waste water properly disposed
Regulation: 511-6-1.06(4)(h),(i) - approved sewage disposal; system; other liquid wastes and rainwater (p) (c)
Base Violation: On left side of property, observed broken sewer pipe with above ground dispersal of sewage. CA: Repair the pipe to the individual sewage disposal system for the restaurant or must connect to public sewer if available within 200 ft.
14C - single-use/single-service articles: properly stored, used
Regulation: 511-6-1.05(6)(r) - single-service/single-use articles, use limitations (c)
Base Violation: Observed the reuse of food cans to freeze water for ice baths. CA: Single-service and single-use articles may not be reused.
15A - food and nonfood-contact surfaces cleanable, properly designed, constructed, and used
Regulation: 511-6-1.05(3)(j) - sink for washing raw fruit and vegetables (p)
Base Violation: Missing sink for washing vegetables. CA: may use prewashed vegetables only or install a vegetable prep sink. If using prewashed vegetables, will need agreement in writing.
15A - food and nonfood-contact surfaces cleanable, properly designed, constructed, and used
Regulation: 511-6-1.5 (2)(jj) - food service equipment, acceptability.
Base Violation: Observed non-commercial cold holding, cooking, and hot holding equipment. Observed replacement of residential stove with another residential stove. CA: when equipment must be replaced, replace with NSF or other equivalent ANSI accredited equipment.
